  • 1 Collection of Personal Data


NAVEGA collects personal data from its users in various ways. When users register on the platform, create a profile, list a boat, or make a booking, they provide personal information which may include, for example:

  • Identity information: full name.
  • Contact information: email address, telephone number.
  • Payment information: payment card details or other payment method information (processed via secure payment platforms; NAVEGA does not store sensitive financial information on its servers).
  • Verification information: documentation or details to verify a user’s identity or a boat’s ownership (if required).
  • Preferences and usage: language preferences, favorite boating destinations, reviews submitted, and any other information the user chooses to add to their profile.


Additionally, NAVEGA may collect certain data automatically through the use of cookies and similar technologies. This automatic data can include the user’s IP address, the type of browser or device used, the operating system, access times, and browsing patterns on the website. The collection of such data is carried out in order to improve the user experience, analyze the platform’s performance, and ensure the security and integrity of our services.


  • 2 Use of Personal Data

The personal data collected is used to provide and optimize NAVEGA’s services. This includes facilitating boat rental transactions between Owners and Customers, securely processing payments, enabling communication and coordination between the parties involved in a booking, and providing customer support when necessary. NAVEGA also uses this data to personalize the user experience (for example, by displaying relevant boats or destinations based on user preferences), as well as to send operational notifications related to the use of our service (booking confirmations, reminders, policy updates, etc.). With the user’s consent, where the law requires it, we may also use their contact information to send internal marketing communications, such as newsletters, promotions or special offers from NAVEGA that we believe may be of interest to our users.


  • 3 Data Storage and Protection


Users’ personal information is stored on secure systems. NAVEGA implements appropriate administrative, technical, and physical security measures to protect data against unauthorized access, alteration, disclosure, or destruction. For example, we employ encryption techniques during the transmission of sensitive data, firewalls, and restricted access controls to safeguard personal information. Furthermore, only authorized personnel and service providers who need to access the data for permitted tasks are allowed to do so, and they are bound by confidentiality obligations. NAVEGA will retain personal data only for as long as necessary to fulfill the purposes for which it was collected, unless a longer retention period is required or permitted by law. When personal data is no longer needed for its original purposes or to comply with legal requirements, NAVEGA will ensure it is securely deleted or anonymized.


  • 4 Sharing of Personal Information


NAVEGA does not sell users’ personal data to third parties. The personal information collected is used exclusively for purposes related to NAVEGA’s services, and as a general rule it will only be shared with third parties in the following circumstances:

  1. External service providers: We may share data with trusted companies that provide services on our behalf or that are integral to the operation of the platform. These third parties may include payment processors, web hosting providers, analytics services, or identity verification services. Such providers receive only the information necessary to perform their designated functions and are contractually and legally obligated to protect the confidentiality of the data and to use it solely for the purposes specified by NAVEGA.
  2. Rental transactions: When it is necessary to finalize and facilitate a boat rental booking, we will share relevant information between the parties involved. For example, once a rental is confirmed, NAVEGA may provide the Owner with the Customer’s basic contact information (and vice versa) so that both parties can communicate and coordinate the handover, itinerary, or return of the vessel in a safe manner.
  3. Legal requirements: We will disclose users’ personal information when it is required by law or in compliance with a binding order from a competent authority. This may include responding to court orders, subpoenas, or legitimate government requests, as well as sharing data necessary to enforce our Terms and Conditions, protect our rights, property or safety, or that of our users or others, as required or permitted by applicable law.


In all of the above cases, NAVEGA ensures that only the minimum necessary information is shared to accomplish the specific purpose, and that any third-party recipient of the data is committed to the appropriate confidentiality and security obligations.


  • 5 Internal Marketing and Exclusive Use of Data


NAVEGA uses the personal data of its users exclusively for operating the platform and improving its services, including its own internal marketing activities. This means that the information collected will be utilized for purposes such as internal analysis, developing new features or services, enhancing the user experience, and sending NAVEGA’s own commercial communications to its users. We will always respect our users’ communication preferences: if a user has given us consent to receive promotional emails, we may send them information about NAVEGA news, special offers, or recommended nautical experiences. Users can opt out of receiving this type of communication at any time by using the "unsubscribe" feature included in our messages or by adjusting their preferences in their user account. It is important to note that NAVEGA will not share users’ personal data with third parties for those third parties’ marketing campaigns without obtaining the user’s explicit and informed consent.


  • 6 User Rights and Legal Compliance


NAVEGA complies with international personal data protection regulations, including, among others, the European Union’s General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) in the United States. In line with these regulations, NAVEGA users have several rights regarding their personal data. These rights include, among others:

  • Right of access: to obtain confirmation of whether NAVEGA is processing their personal data and, if so, to access that data along with information about its processing.
  • Right of rectification: to request the correction of inaccurate or incomplete personal data.
  • Right to erasure (“right to be forgotten”): to request the deletion of their personal data when it is no longer needed for the purposes for which it was collected, or when the user withdraws consent (if the processing is based on consent), among other circumstances provided by law.
  • Right to restrict processing: to request that the use of their personal data be limited in certain circumstances, for example, while the accuracy of the data or the legitimacy of the processing is being verified.
  • Right to object: to object, on grounds relating to their particular situation, to the processing of their personal data that is based on NAVEGA’s legitimate interests. Similarly, users have the unconditional right to object at any time to the use of their data for direct marketing purposes.
  • Right to data portability: to receive a copy of their personal data in a structured, commonly used, machine-readable format, and to transmit those data to another controller when technically feasible, in the scenarios contemplated by applicable law.
  • Right to withdraw consent: in cases where we process personal data on the legal basis of the user’s consent, the user has the right to revoke that consent at any time, without retroactive effect.


To exercise any of these rights, users can contact NAVEGA through the channels provided, such as the dedicated privacy support email address or the contact form available on the platform. NAVEGA will assess and respond to all valid requests within the timeframes established by applicable law. Exercising these rights is free of charge and will not affect the user’s continued access to NAVEGA’s services; we will not discriminate against any user for exercising their privacy rights. Finally, if a user believes that the processing of their personal data violates any data protection law, they have the right to lodge a complaint with the competent supervisory authority in their jurisdiction.
