  • 1. Role of NAVEGA as Intermediary


NAVEGA is an online platform that acts solely as an intermediary between boat owners ("Owners") and customers seeking to rent a boat ("Customers"). NAVEGA is not a party to the rental contract established between the Owner and the Customer, and therefore assumes no responsibility for any incidents, damages, or accidents that may occur during the rental. By using the NAVEGA platform, both Owners and Customers acknowledge and agree that NAVEGA is exempt from any legal involvement arising from the rental relationship between them.


  • 2. Owner Responsibilities


Each Owner is fully responsible for any incident or accident that occurs in connection with the use of their vessel, including any resulting damage or injury. The Owner is obligated to ensure that their boat is always maintained in proper working condition and complies with all applicable maintenance and safety standards. The Owner must have in place all relevant insurance policies that cover possible accidents or damages related to the vessel and its rental activity. Likewise, the Owner agrees to provide truthful and complete information about their boat and to honor the terms agreed upon with the Customer (such as schedules, meeting locations, rules for use of the vessel, etc.).\


  • 3. Customer Responsibilities


Each Customer is responsible for their own safety and that of their guests during the rental period, as well as for any damage they may cause to the vessel or to third parties. The Customer agrees to follow all instructions and rules of use provided by the Owner for the vessel, and to abide by all local laws and regulations while operating or using the boat. If the Customer will operate or pilot the boat themselves, they must hold any licenses or nautical certifications required by local regulations, or otherwise hire a qualified captain or skipper. Any negligent behavior, misuse of the vessel, or violation of rules by the Customer that results in damage will be solely their responsibility.


  • 4. Compliance with Local Regulations


Owners are required to strictly comply with all local laws, regulations, and rules applicable to boating and boat rentals in their jurisdiction. This includes, but is not limited to: obtaining all valid navigation licenses and permits, adhering to harbor or port regulations, executing any rental contracts required by local authorities, and observing all maritime safety measures (for example, providing life jackets, emergency equipment, passenger capacity limits, etc.). The Owner guarantees that they possess all certifications, registrations, and documentation necessary to legally operate their boat as a rental. Likewise, Customers must also respect the local navigation and tourism laws in the areas where they use the boat.


  • 5. Insurance and Liability


It is the sole responsibility of the Owner to obtain and maintain adequate insurance coverage for their vessel and rental activities, including liability coverage for third-party claims. Any incident, accident, injury, or damage that occurs during the rental should be handled through the Owner’s insurance and/or by the parties involved, with NAVEGA having no responsibility whatsoever. NAVEGA is expressly released from any legal liability for incidents that occur during the rental of the vessel. Additionally, it is recommended that Customers consider obtaining personal travel or accident insurance for their own peace of mind, although primary responsibility lies with the Owner and their insurance coverage.


  • 6. Commissions and Fees


NAVEGA operates on a commission-based model for its intermediary services. The Owner agrees to pay NAVEGA a commission for each completed booking made through the platform; this commission is typically a percentage of the agreed rental price. On the Customer’s side, at the time of booking, an additional service fee may be applied for use of the platform. All applicable commission rates or fees will be transparently disclosed to both parties before a booking is confirmed. NAVEGA reserves the right to modify commission rates or service fees, but any such changes will be communicated to registered users in advance. Payouts of earnings to the Owner (the rental price minus NAVEGA’s commission) will be managed through NAVEGA’s payment methods within the established timeframes once the rental is completed, in accordance with the conditions agreed on the platform.
